Ok, yes i know it comes off with the key, but i'm turning the key and nothing is happening. I sounds like the cable is moving, but it's not releasing. How do i get if off without knackering the seat hump or fairing? The battery is flat so i need to put a trickle charger on, so if there is a way of getting the front seat off i can live without the rear seat hump coming off.

It's a 2005 ZX10r.

Try pressing down on the seat hump near the  rear of the hump as you turn the key.

Hmmm, had a look at mine and I'm afraid it doesn't look good for you :(
Cable is very short from the catch to the lock assembly so not much to play with
The catch is at the front so better trying to press and jiggle at the front of the hump rather than the back, where it is just the plastic hook type bit
If you have the workshop manual, top of pg15-18 shows the lock assembly inside the rear cowl
Take the black side-cover off and you may be able to reach up inside with a small hand or trained hamster to pull the cable, but sounds like your problem is more likely a sticky catch if the key is turning reasonably well
Beyond this, guess you're looking at breaking through the plastic above the front seat (£32 part!) and then you will get to the seat bolt to take this off and get to the battery
Even then, breaking into the back doesn't look easy but it gets you closer to the grubby bits  ;)
Shout if you want any pics from mine as got my battery out at the mo' in pre-season prep'

These have all been outrageously helpful suggestions so far!!

The answer to your question should be, 'with a hammer'.

I've just had the thing painted so i'm loathed to hit it with a hammer

Can you get the under-tray removed, you may get some access from below. Can you see the mechanism at all to see if the cable is still attached and working? Blast in some wd40, if it's just a bit sticky it might be all it needs to free it off!
